Remote session for Tuesday, 6/27- Disposition for Jim Butler

Read about Jim Butler on page 491.
You are the juvenile court Judge and have to decide his disposition. Choose a dispositional option from chapter 15 ranging from probation to secure corrections that you think would be most appropriate for Jim and his case.
Be specific as to his disposition. Why did you choose this option? What are your goals for the disposition of this this case and how will this disposition meet the goals?
Explain and keeping in mind that each sentencing option has different things to offer.

Although Jim is only 13 years of age. His previous record speaks for itself. Number one if Jim is expose to the pat on the back remedy such as [probation] he probably will be back in front of me in six months with the little boy scared look. Number two if we take the [halfway house ]approach that means he still can go out and make serious offenses in the community . The grandmother is a senior citizen and has said that he's a good boy ,he just needs a little guidance. I would take that in consideration, and how old she is. This would lead me to my decision to give Jim a special deterrance punishment. With Jims case his prior actions speak for itself. As the judge in this case I would give him three years in a juvenile correctional facility. The object is to take Jim off the streets and let him know the law will not tolerate this kind of behavior just because you are under age and had a bad childhood. As the appointed judge over this case after Jim is sentenced for this crime ,and after he has done his time ,then it would be safe to make a decision to see if he is remorseful or not. We have to be reminded this is not his first brush with the law.Armed robbery is a serious offense and punishable up to fifteen years. A slap on the wrist is no way to handle a criminal such as Jim even if under aged.A secure facility is the best judgement for Jim to protect society from him and to protect Jim for himself.

The dispositional option that I think would be most appropriate for jim and his case is balanced probation. Balanced probation is restorative justice -

1) Offender and victim discuss the crime; helps the community; juvenile take responsibility of the crime; a program to improve the offender is started.

I choose this option for jim because his case is complicated. Jim respect adult jim will feel sad and ashamed when he has to meet his community to discuss his crime. Next, jim is very influenced by friend. The probation officer will keep them away from a bad friend. For example, and he will not have a chance to meet a bad friend.

Jim is above average intelligence so he should understand when the community explain to him what he did wrong. when the victim talk to jim how he hurt her and fighting her jim understand how the woman felt. The probation officer has to make sure jim go to school in stay away from the bad kids and stay in the house. The probation officer will help the grand mother learn how to work with jim.

The probation officer have some goal for jim:

A) Keep jim out of jail so he is not influenced by bad friend.
B) His intelligence- graduate from high school and learn a grade or to go to college.
C) Learn how to refuse bad friends.
D)Respect the people and not to commit crimes.

In the disposition he has to stay away from bad friend, going to school, respect people and not to commit crime.

If I was a juvenile court judge hearing Jim's case I would take into consideration that he has a long history of being on probation for drug possession, stealing a car, and shoplifting between the ages of 11 and 12. Now he has been accused for armed robbery with a knife against a woman while stealing her purse at the age of 13. I would send him to a secure facility for three years not sending him to a facility within the community until after he has served his time because the majority of his actions were within the community. Then after three years Jim should serve a minimal time of a year on house arrest being closely monitored while going to school, and community service to make sure that he is able to return to the community. I chose this disposition because this child needs to be severely punished and made aware for why he is receiving this punishment. A child should take responsibility for their actions. He was on probation for quite a few times at an early age which gave him the impression that his behavior was acceptable to society and from the juvenile justice system. I believe that the goal for this disposition is to be scared straight in order to be enforced that this behavior or actions is not going to be accepted from society. This disposition will meet the goals by providing enforcement upon the child, informing the child about his reasons for being sent away to a facility for three years and that it is a form of deterrence, and letting the child know that he will be held accountable for his actions.

As a local juvenile court judge hearing the case of Jim Butler I would have to be firm with him and send him to a secure incarceration facility for three years. Although he is only 13 teen, i believe that Jim understands the seriousness of his cases. With this being said I feel that three years is more then enough time for Jim to get him self together and get on the right path bout time he turns 16 teen.In Jim case it states that Jim is good kid, but I also feel that Jim takes advantage of that and constanly get off because of his sob story. This sentence will help Jim become reasonable for his own actions, and help him understand that life may be hard but you must live for you. This disposition deals with enforcing the rules of the law with kids who committ serious crimes, after the sentence I beleive that this would be a great deal of detterance for other children that may be headed down a path like Jim's.

It would seem that the easiest thing to do would be to take Jim off the streets, lock him up and let that be that, but I don't think that's the correct approach. A big part of Jim's problem is living with his grandmother. She's up in age and although Jim does go to school, there is really no one there to give Jim the attention or guidance that a young person his age needs once school the hours are over.
Another part of the problem is that he has fallen in with the wrong crowd, the same crowd that is the root cause for his last offense, so placing him in an institution with what seems to be the same kind of crowd only older and tougher could do more harm than good since he seems to be so easily influenced. My decision would be put him in the intermediate program/community based were he can continue to get his education since he's an above average student and were he can go to group session with kids who have the same trouble and are probably the same age. Hopefully, if Jim sees that he is not alone in his battle to do better, he can actually do better. Also, being put in with peers his own age, can probably help to develop much needed positive social relationships. I'd be the first to admit that all of Jim's crimes were all very serious however, I believe that with the right guidance Jim can and will be able to turn himself around in a positive way.

After reviewing Jim Butler’s case on page 491, the dispositional option I find suitible is putting him into an intermediate program, such as a community-based facility. I came to this decision due to his young age and personal background. I see the boy has potential to do better for himself, if surrounded by positive role models to lead him in the right direction. There is evidents of him being very intelegent in school and well respected by his teachers. That is enough significant proof that proves to me he will greatly benefit from a community-based facility.
His parents were supposed to be his role models, but since his mother isn’t able to care for him due to undergoing inpatient treatment at a local drug facility, and his father who left him astray, all he has is grandmother. His grandmother is getting older, and it is harder for elder people to keep after young children. Jim had his only easy resource; to look at his peers who are in the same position, or worse then he is and he can identify with them. This puts him in danger of getting caught up in deviant behavior, because he wants to be accepted by his peers. He needs to have some type of social bonding in his life. That bonding became negative, which caused him to constantly get himself caught up in the criminal justice system.
Looking back at Jim Butler’s case, he wasn’t sent to an intermediate program before, he was just sent home with his grandmother with a slap on the wrist and to not let it happen again. He needs more than just being monitored on probation at his grandmother’s house. He also doesn’t need to be sent to a secure incarceration facility for up to three years, because of the type of crimes he commited didn’t take a person’s life. What he needs is to go to an intermediate program as a restorative practice to teach him positive problem solving strategies, consequences of negative behavior, and how to use his school intelegance to his advantage.

After reading the Jim Butlers’ case, the most appropriate dispositional option is residential community treatment. Precisely, foster care programs wherein juveniles enter into a close relationship with the foster parents and receive the attention and care they did not receive at home; over the period of time juvenile become less likely to be arrested .
I chose this option ,because Jim did not have the social bond with his parents whom were suppose to nurture him with home training ethics. for example, Jim would learn not take what is not belonging to him, would not lie, would learn how to be responsible about any act committed. Foster programs also have a multidimensional treatment foster care (MTFC) program that is designed for the most serious and chronic male young offenders. It helps teach juveniles skills building as in how to build a relationship between peers and adult, at jobs, in the community and creating self esteem. Secondly, Family therapy for biological or adoptive parents as in the parents learning and getting adjusted, to youths while providing close supervision and making them to know their limits, right and consequences towards any behavior.
Regardless of Jim devious act, he is very intelligent and will understand the difference in environment, moving from this guardians to a foster home and the roles and regulation of his new home. The surrogate parents will make sure he received the nurture of his parents that he’s missing.
Goals for Jim would be as follow: 1. Having him go through an individual therapy (making him to recognize who he is and has come to benefit himself in society).
2. keeping him in school with close supervision on his daily attendance ,school work and foster parents.
3 .discuss frequently his behavior as he progress. Example. Having a data sheet at home and school about his daily activities.
This program will divert Jim from delinquency, establish parental bond, moral values positive decision, high self esteem and will encourage higher education.

As a juvenile court Judge my disposition for Jim Bulter(13year-old) is to send him to a home detention. The child will be restricted from his home and moved to a secure facility or home as a placement.Rules and regulations for the home or facility include regular school attendence,curfew observance, avoidence of drugs and alcohol and notification of parents and the youth worker of the child's whereabouts.
I chose this disposition because Jim Butler only guardian is his maternal grandmother and do to her age she is unable to monitor Jim's activities, so he can not live with her and be on probation.I also chose this disposition because of a statement a representative from his school system testified that Jim has above average intelligence and is actually respectful of teachers.
The goals for this disposition is to help Jim Butler get on a schedule and to be under adult supervision at all times. This disposition will meet the goals because Jim will be under adult care and will not be able to continue his delinquentbehavior. It will also keep him away from his "bad companions" according to his grandmom.

As a juvenile court judge, I would give Jim the special deterrence sentencing. Even though I would consider the age of the grandmother and the relationship between she and Jim, the sentence would remain the same. With this sentence, Jim would be off the streets and placed into a facility for three years. Those three years gives him a time to grow. It is also a separation period from his grandmother, one who really loves him. While he is away, he could consider everything about himself and come to an acceptance with it. With his excellence in school, he could put his mind to use while away. It would be beneficial rather than destructive. Hopefully when he comes home, the three years would pay off. He would appreciate the time alone, the sentence I gave him, and his grandmother for being there. And then I would hope I would have to see him in my courtroom again.
